59 – Malorie Peacock – Discover Your “Why”: Committing to Organizational Health

In this Trial Lawyer Nation podcast, Michael sits down with his law partner Malorie Peacock. They discuss their recent “deep dive” 2-day management retreat, the organizational health of your law firm, Zoom jury trials, and implications of the shut down on future business.

The episode begins with a review of their firm’s recent 2-day management retreat, which was a “deep dive” into their firm’s core values, focus, and goals based off the book “The Advantage: Why Organizational Health Trumps Everything Else in Business” by Patrick Lencioni. The retreat starts off with a seemingly simple question: Why does our law firm exist? Michael admits he was worried everyone would think the idea was “hokey,” but Malorie insists she was surprised at how complex the question really was. Michael, Malorie, and the rest of their management team spent significant time reflecting on this and decided their firm’s purpose is to “provide a ‘Special Forces’ level of representation to people who are hurt.” Michael recognizes this as an extremely high aspirational standard (which is why he hesitated at first to share) and sees this as their goal for the firm.

After deciding the firm’s purpose, their team was tasked with choosing the firm’s core values. Both Michael and Malorie emphasize the importance of choosing values you will embrace and commit to. As an example, Michael highlights the common PI lawyer core value of safety. He asks, “What do you do when you get a 5 million dollar offer without a safety change, or 1 million dollars with a safety change?” If the firm’s core value is safety, they should take the lower offer. Malorie echoes this sentiment and adds that PI lawyers face a lot of backlash from society, so they tend to overcompensate by expressing an unrealistic emphasis on safety over getting justice for their clients. The key is choosing values that truly represent your firm and its goals.

On the note of goal setting, Michael explains the importance of choosing one large goal and sticking to it. Citing Gary W. Keller’s book “The One Thing,” Michael reflects on past experiences of having lots of great ideas, but something would always come up and they would be forgotten. By choosing the one area which adds the most “bang” to your law firm, you can truly focus on that area and strive towards your goal every day. This strategy requires buy-in and personal work from every attorney at your firm, but when achieved is very effective.

Michael and Malorie then reflect on the implications of states re-opening and how it affects their ability to conduct legal work remotely. Malorie has already had opposing counsel insist on doing things in person again, but worries about what she’ll do down the line if the court forces her high-risk client to have an in-person deposition. Michael shares these concerns, stating “eventually I’ll be ordered to do something I’m not comfortable doing.”

As they switch to the topic of Zoom jury trials, Michael is quick to share his hesitance towards the idea. His concerns include a lack of nonverbal communication, distractions, a loss of group dynamics, and the inability to obtain a representative jury pool by excluding citizens without adequate internet or access to childcare. He does add that online focus groups have shown the numbers aren’t very different from in-person jury trials, but he would like to see more research before committing to one. Malorie also notes an interesting difference between an in-person trial and a virtual trial. In a virtual trial you have to sit in the same place for the entirety of the case, which means you can’t have witnesses act things out, do demonstrations, or have multiple ways of showing people information. This makes it more difficult to keep the attention of the jury. Michael and Malorie end this discussion by agreeing if this goes on for years, they will eventually have to adapt. They finish off this episode with a conversation about future business implications because of this shut down. Malorie has noticed more people on the roads recently and only anticipates a 3-4 month lull in new cases, but believes it will pick back up quickly. Michael agrees and adds that people are getting stir crazy, and driving more recklessly than before, stating “gear up and get ready.” With that being said, Michael and Malorie encourage scrutiny when deciding what cases to invest in right now. Malorie believes small insurance companies may be less willing to pay out claims, and Michael is being very cautious with cases involving a risk retention group or a self-insured company. Many are currently teetering on insolvency and may not be able to pay out claims.

52 – Karonnie Truzy – Iron Sharpens Iron: How Practicing in a Tough Jurisdiction Makes You A Better Lawyer

In this Trial Lawyer Nation podcast, Michael Cowen sits down with attorney Karonnie Truzy from North Carolina. This show covers everything from contributory negligence, to gross negligence, making your case about the company, 1983 civil rights cases, and the simple things attorneys can do to help with diversity and inclusion in our industry.

The conversation starts with a discussion on how to maintain a work-life balance, as it is certainly a big issue for the legal industry. Simply put Karonnie believes, “people make time for things that are important to them.” He shares how hard his paralegals work to make sure travel takes place in the middle of the week so on weekends he can be with his family. His law firm is also supportive and will proactively tell him to take some personal time when he’s spent long hours at the office (a rarity you hear about at big firms). And he shares a great example of their care for him when he injured his Achilles last year.

Contributory negligence is the next topic discussed and an important one. North Carolina is 1 of 4 states with contributory negligence, essentially stating if you are found to be ANY percent at fault and responsible in ANY way for your injury you cannot recover damages. It is a complete bar, which is different from other states with a comparative negligence between the plaintiff and defendant. “Wow. So how do you deal with that?” Michael asks (clearly the same thought on everyone’s mind). It starts by accepting cases on a case by case basis. But it’s also incredibly important to do a lot of investigation work at the very beginning from talking with witnesses and law enforcement, to gathering video evidence. And while contributory negligence is difficult Karonnie also discusses “last clear chance” and “gross negligence” as ways to get around it.

Michael and Karonnie then discuss what can be done to make a case about a company and not just the driver in order to make it a bigger case. To begin Karonnie shares why it is important to have everything you need in discovery from employee handbooks to training materials. JJ Keller is often referenced, so Michael adds why these materials can be useful to plaintiff attorneys by giving an example of how his law partner Malorie Peacock is using the JJ Keller training to learn what the rules are and what people should be trained on for a unique explosion case. Karonnie then explains how he organizes his depositions and uses 30(b)(6) to know he is deposing the right people in the case (30(b)(6) is discussed in detail in episode 30 with Mark Kosieradzki).

Karonnie also handles 1983 civil rights cases, which leads to a discussion of qualified immunity with police officers. You’re usually not the attorney riding in on a white horse and most jurors already believe your client did something wrong. So how do you handle juror perception? In most cases like this the police department will hold a press conference and news stories will be shared, so Karonnie will use this footage to ask whomever made those statements “was this truthful, was this actually what happened?” He does this in front of the jury, so they can see how these statements before a proper investigation can skew their perception because the information was inaccurate. The same inaccurate information also aids in mean comments on media articles, which Karonnie purposely does not read. However, the conversation comes full circle when Michael shares he reads those mean comments to learn about hurdles he has on a case and Karonnie states he does this with focus groups whether it’s a civil rights case or a trucking case.

Explaining the dynamic of a family after they lose a loved one is critical in our industry. But sometimes we as attorneys have to explain to a jury why the value of life is the same no matter who it is. If our client was not the perfect person and lost their life, “we take away the opportunity for redemption” Michael poetically states. Karonnie responds with a heartfelt example of a case where in deposition the daughter of a deceased client describes why she is upset about the loss of her father when her relationship with him was not great. It’s a story that will undoubtedly resonate with everyone and may bring some to tears as they realize just how precious every day is in life.

The topic of “diversity and inclusion” is often discussed in the legal industry. Karonnie recently finished his 3 year role as Chief Diversity Officer for the North Carolina Advocates for Justice and shares how this role was created to work to on this issue. But change doesn’t just happen, it has to be real and not “just words on a paper” he explains. Michael shares his simple, yet effective, way of simply inviting new people to join a group. This leads Karonnie to describe the impact cliques can have within an organization, or when attending a CLE, and why it’s important for attorneys to realize when this happens you leave people out and it can create a problem. It’s a truly honest and open conversation on what can sometimes be an uncomfortable topic to discuss.

40 – Ken Levinson – Focus Groups and Metaphors

In this Trial Lawyer Nation podcast, Michael Cowen sits down with Ken Levinson, a successful trial attorney who is also very active with his trial consultant focus group practice, for a discussion on how his unique practice is getting big results in the courtroom. Ken selfishly loves his “split practice” primarily because of its process of constant learning which comes with both sides of his practice, noting that he’d never want to give either of them up.

The conversation begins by exploring focus groups, as Ken talks through how they help in cases because lawyers are able to find out what resonates with people and then test it before ever stepping into the courtroom. “Over time, I’ve learned the better approach is to accept what people tell you. Listen, and in a neutral way, find out what’s going on.” Ken goes on to say “I don’t want to fall in love with my case or a witness or a theory without really stepping back and almost looking at your case in a different way” which is exactly what focus groups help him do while pointing to the teachings of Michael Leizerman [link to Michael Leizerman episode] of needing to have a “Zen mind” or a beginners mind. He adds “I think we get lost in the language of being a lawyer and I’ve really tried to train myself to talk like real folks in everyday life about our cases.” Michael then points out how it is incredibly important to be yourself, noting the power that authenticity brings to human communication both inside and out of the courtroom.

After working with so many great lawyers, Michael wonders what Ken has seen separates the good from the elite. Ken points out two factors he’s seen in elite lawyers: 1. They know their cases inside and out and although they may seem to talk very casually about things in the courtroom, they actually work extremely hard; and 2. The better trial lawyers he’s gotten to know are always learning. Ken goes on to point out there are some firms he might do 20+ focus groups for in a given year, and although they have been getting multi-million dollar verdicts for decades now, they are always learning, testing, reading, revising, and thinking about how to improve.

Michael speaks to his own experiences on learning and how over the years, while there are some basic human things that don’t change, many things do change over time and thus, lawyers need to be open to continuing to learn in order to be effective in the courtroom. Ken follows up to describe some of the other things he’s doing to continually get better, such as reading a lot on decision-making, psychology, and metaphors, then discussing what he’s learned with friends and colleagues, testing things for himself in focus groups, case preparations, depositions, and in the courtroom. He also goes to seminars and holds in-house trainings. Ken also discusses some of the ideas he’s learned from R. Rex Parris [link to Rex episode] on metaphors and how he’s been able to incorporate them into his courtroom proceedings.

Talking more about Ken’s experiences with focus groups and testing theories within them, he describes a few exercises he’s used to better understand the imagery that focus group juries associate with their case using simple techniques. Then he takes things a step further to discuss the findings, one-on-one, with the focus group participants. Through this process, he’s discovered many great metaphors and images that have helped his cases as well as some that needed to be tweaked or reworked for a case, noting that it’s better to find out and understand things which can negatively impact your case prior to trial, than during it, of course.

Beyond running his law firm and focus groups, Ken has also written books and articles, which begs the question – how does he have time for all of this? Ken describes his methods of time management which include getting up several hours before his wife and kids, but also includes time blocking and scheduling things based on his own understanding of the best times for him to get work done, which he details more in this episode. Michael also talks through the structures he’s implemented in his life and his firm to help to “move the ball forward” toward accomplishing his goals.

Michael turns the conversation toward what lawyers can do to set themselves up to achieve their goals, whether it is getting a $43 million verdict or a $6 million settlement, to which Ken turns the table a little bit and points out some great advice he had heard from Michael about taking on the right cases and turning away the others. Michael elaborates on this point and discusses the juxtaposition of the normal mentality associated with turning down cases, which really hits the nail on the head in terms of getting more of the types of cases lawyers want to get and building their practice.

Their conversation rounds out in a discussion revolving around the terms Ken has seen come up over and over in focus groups involving trucking cases specifically. Ken talks about terms he’s found to be important to focus groups and juries alike such as “professional driver,” and ideas revolving around vision and forgiveness. Truly insightful information that Ken discusses more in depth, which not only brings perspective to trucking cases at their face value, but also the impact focus groups can have in helping to bring another element of humanity into our cases by getting the perspectives of what’s important in the eyes of others.

Education

After receiving his Bachelor of Arts degree from Hobart College in 1989 and his Juris Doctor in 1992 from Case Western Reserve University School of Law, Ken was appointed an Assistant Illinois Attorney General, representing state agencies and employees in civil matters, including both personal injury and civil rights cases. He has been admitted to practice before the Illinois Supreme Court and the Northern District of Illinois, United States District Court since 1992. Levinson is also admitted to the Federal Trial Bar.

 

Personal

Ken volunteers his time and resources to a variety of community and charitable organizations in the Chicago area, such as sponsoring the Tristin Speaks Benefit, which raised funds for autism awareness. Ken is a former member of The Citizens’ Council of LaGrange, a non-partisan community group that promotes better government through the recruiting and evaluation of candidates for local public office, having co-chaired the Council’s Qualifications Committee. Ken participated in the 39-mile, two-day Avon Breast Cancer Walk and the St. Jude Walk/Run to End Childhood Cancer. Ken also supports Art in Motion, an event hosted by the Associate Board to raise funds for the Rehabilitation Institute of Chicago, now known as the Shirley Ryan AbilityLab.

Ken is an area native, born in Chicago and currently living in LaGrange, IL. He is happily married and the father of three boys, keeping him very active in youth and sports-related activities. One of his favorite pastimes is to go with his wife to their sons’ high school varsity games and in-state and out of state tournaments for basketball and volleyball.

In this Trial Lawyer Nation podcast, Michael Cowen sits down with well-known attorney, author of 30(b)(6) Deposing Corporations, Organizations & the Government  and Deposition Obstruction: Breaking Through, and long-time presenter at countless legal events, Mark Kosieradzki. This is the best legal podcast for new lawyers.

Mark recalls growing up with parents who were scrappy, rightfully so given their startling history, who instilled in him to stand up for principles, ultimately leading him down the path of becoming a trial lawyer. He points out that many go into the field with a “win at all costs” type mentality, but his father always told him that “if you cheat to win, you really didn’t win,” which he continues to carry with him throughout his successful career in law today.

Mark describes one of the most successful tools he has learned to use in the courtroom are the rules themselves. He finds it to be a lot less stressful when you use the rules to get to the truth and if you play by the rules, you can force the other side to play by them too, which most times is not to their advantage. When Michael asks him how he might know if the opposing side is hiding something from you or not telling the truth, Mark very candidly replies that he starts with the premise that they are, and that trial lawyers want to tell the jury a story whereas a litigator wants to hide evidence. He goes on to impart that when they say they are going to give you “everything,” it’s really more like code for saying we’ll give you everything that doesn’t hurt their case.

Mark shares his evolution of new techniques regarding how he approaches depositions. He starts with a lot of case analysis, storyboarding, puts all his information in “buckets,” and then looks at what he’s trying to accomplish. With that, he starts with the assumption that one person could provide all the information, then structures an outline of what this one person could tell him and works at it to identify what documents are being electronically stored. Then he creates a request for production but doesn’t serve it, knowing there will be immediate objections. Next, he creates a 30(b)(6) designee deposition with a schedule of documents in it but doesn’t request the documents. We’d like someone who can provide all known documents in the organization that exist in this category, Mark continues. Where are they located, how are they organized, and most importantly, what are the methods available for searching? Without having requested anything, we are establishing the most effective and efficient way to request the electronic information, while also preempted all the boilerplate objections before we ask for them. Michael wonders about getting any push back regarding doing discovery on discovery to which Mark explains there is no discovery on discovery because you haven’t asked for the documents yet. Which is brilliant!

Michael asks how Mark structures his life to where he has time to storyboard, plot out cases, take depositions, and then craft his cases. The simple answer, Mark replies, is to just say “NO” to cases, continuing to say that his firm currently turns down 6-8 cases a day and work with small caseloads. Mark remembers starting out as a volume lawyer with 250-300 cases and works with the mentality of getting as many cases as you can and then you settle them based on getting each case’s fixed value with as little work as possible. That type of nonsense, however, assumes that the other side determines the value of each case. He’s also found that by spending more time up front on a case, their hourly value has gone up significantly because they take the time to get the evidence and prove each case. Michael relates his own firm where he’s found the fewer cases each of his lawyers have, the more revenue each lawyer generates. Settlements have gone up, the time from intake to the settlement has gone down, and the personal satisfaction of being able to be a craftsman of doing good for clients is significantly rewarding. It wasn’t until he got rid of the fear in his own mind that if you tell a referring attorney “no” on a case, they will disappear forever. When, in fact, the more time you can spend on the right type of case for yourself, the better the outcomes will be, and the more people will respect you and your practice. It also allows you more time to communicate with your clients which allows them to trust you more by knowing you have their best interests at heart.

The conversation shifts to talk about storyboarding cases. Mark describes the process as for where you lay out what your story to the jury ultimately will be and how you will focus the jury to consider the information which is important in your case. Mark points out that there are many great resources like Cusimano, Wenner, Rick Friedman, Carl Bettinger, and David Ball who have different methods of storyboarding cases, all of which are great, but he doesn’t subscribe to just one method. He explains how he tries to learn ALL the different methods because this is not a checkbox profession, but rather one requiring you to stay nimble in your approach in order to be able to counteract whatever gets thrown at you from the other side. In general, he starts first with a chronological account of the case from beginning to end, which admittedly isn’t always the most persuasive one. Then he begins to craft what he would like the jury to focus on first which in most cases is the decision making that has taken place by the wrongdoer. Mark shares a story using the information availability method that really drives the point home on the importance of sequencing details. Then to take things even a step further, they begin to formulate through whose eyes will they tell their story which is equally important given that there are hundreds of perspectives a story can be told…just ask Stephen Spielberg.

Michael and Mark round out this podcast by hitting on hot-button issues including how to structure your questions to establish if the person being deposed is prepared, what you are really trying to get out of a deposition, and how to prove your oppositions unpreparedness. Mark also talks through a real-life example of how all these different techniques were used in a past case of his: Boswell v. Sherman County. The details of which are simply astounding and need to be heard for yourself. They wrap up with a brief discussion on what the future holds for Mark and even sneak in a little surprise at the end.

24 – Michael Leizerman – The Zen Lawyer: Winning with Mindfulness

In this Trial Lawyer Nation podcast, host Michael Cowen sits down with a brilliant trial lawyer, national speaker/lecturer, and author, Michael Leizerman. Cowen has learned an enormous number of methods and approaches over the years from Leizerman who takes mindfulness to a whole new level in and out of the courtroom.

The discussion begins with an in-depth look at the “beginner’s mind” and understanding how it adds to a case, and life, infinitely. Leizerman uses the example of the hierarchy of karate, where becoming a “black belt” is commonly misconstrued as becoming a “master,” when it simply means you are at the first level of Dan, meaning you are now a beginner once again. He also points out that he takes it upon himself to know when he feels like he has mastered anything, he needs to remind himself he is just a “beginner,” otherwise the jury will, his wife will, or life, in general, will remind him. As the discussion progresses, Leizerman and Cowen discuss the idea that in the beginner’s mind, there are many possibilities, whereas, in the master’s mind, there are few. Leizerman likes to bring this mindset to many aspects of his work and discusses how he uses it in depositions, saying, “There’s a feeling like I’ve never done one before” while holding confidence about himself knowing exactly what he wants to get out of the time.

In each case Leizerman approaches, he works to become mindful of what he calls “the 5 core truths,” which are also the basis of his book The Zen Lawyer: Winning with Mindfulness, as well as an essential part of the workshops he puts on with Joshua Karton [link to his episode] and Jay Rinsen Weik. He describes the mindfulness around the 5 core truths (Physical, Emotional, Logical, Motivational, and Zen) as being seen as simultaneous truths in every case and with the understanding that each core starts with the lawyer and their own understanding and experience. Leizerman talks through examples of each core including a powerful example where emotional truth was used in a case to show where a father’s simple love for his son led them to put the case on the line and not ask any questions of a witness. He also reveals how he used the 5 cores in a case which led to a record wrongful death verdict in Ohio and also why he believes lawyers don’t get large verdicts or are disappointed in verdicts. Hint, hint, it’s all based on these core truths.

Cowen and Leizerman agree sometimes trial lawyers forget that jurors, in general, want to see good done and want to help people and these core truths can motivate jurors to see their way to the best outcome based on their own truths. Leizerman also talks through the “curse of knowledge” we, as trial lawyers, have when we’re in front of a jury and it sometimes goes over the jury’s heads to where they feel “submerged” or lost in all the details.

Leizerman recalls coming to the conclusion after dissecting a case post-trial: we tend to bring the anger of a case to the courtroom without allowing the jury to experience it. Having a beginner’s mindset allows him to be the one who is grounded and the one who people look to for guidance vs. seeing him as the angry attorney who gets mad when things don’t go as planned. He finds that allowing the jury to experience the frustration for themselves when a defendant tells different stories that are contradictory instead of the lawyer pointing it out and calling them a liar, can become the lynchpin in a case. It comes down to letting the jury experience it for themselves vs. the jury trying to experience it through the upset lawyer. He makes note that when you get angry, it takes away the anger from the other party, even in many other significant relationships. In other words, if you get angry in the courtroom, often times it takes the anger away from the jury, the individuals you really want to experience the anger. He also points out if we were just analyzing the facts of the case, we could use a computer for that. We’re in the courtroom to live through the case and be the case that gets decided by the jury.

Cowen extracts many more nuggets of mindful wisdom from Leizerman throughout their conversation, including a hint to a possible addition to Leizerman’s authorship with a book on transformational storytelling, as well as how listeners can learn firsthand from him at the various workshops he holds throughout the year. This was definitely an exceptionally insightful interview with Leizerman and we look forward to learning more from him in the near future.

Michael Jay Leizerman is the co-founder of the Academy of Truck Accident Attorneys (ATAA). He concentrates his practice in select catastrophic injury truck collision cases across the country.

Michael is the author of the Thomson West/AAJ three-volume treatise, Litigating Truck Accident Cases. He was the first Chair of AAJ’s Trucking Litigation Group. Michael attended truck driving school and obtaining his Commercial Driver’s License while managing his law practice.

He has taken 14 truck and bus cases to trial in the last decade. He has received record-breaking truck accident settlements and verdicts across the country, including multiple verdicts with punitive damages.
